內容簡介

　　《國際私法（英文版 第2版）/高等院校法律專業雙語課程規劃教材》作為國際私法英文及雙語教學的教材，對國際民事訴訟管轄權、法律選擇、外國法院判決及仲裁裁決的承認與執行等事項作瞭詳盡而深入的分析與介紹，並結閤新案例對中國國際私法的司法實踐進行瞭評述，《國際私法（英文版 第2版）/高等院校法律專業雙語課程規劃教材》第一編“導論”，分為三章，第一章交代國際私法的名稱、範圍、性質、存在理由等事項；其餘兩章則分彆探討瞭國際私法的淵源與本學科的一個重要概念——“衝突規範”。

作者簡介

　　霍政欣，中國政法大學教授、博士生導師、國際法學院副院長，兼任聯閤國教科文組織觀察員、英國阿伯丁大學國際私法研究所研究員等職，主要研究領域為國際私法、比較法、國際文化財産法等，入選2012年度“教育部新世紀優秀人纔支持計劃”及中國政法大學首批“優秀中青年教師培養支持計劃”。
　　作者於2005年畢業於武漢大學，獲國際法學博士學位；學習及工作期間，曾赴奧地利、荷蘭、美國、韓國、英國等二十餘個國傢的高校或研究機構進行長期或短期訪問研究，已齣版中英文專著四部、譯著三部；在“American Journal of ComparativeLaw”、“Intemational＆Comparative Law Quarterly”等國際主流法學刊物上發錶英文論文二十餘篇；在《法學研究》、《法商研究》、《法學評論》、《比較法研究》等國內權威及核心法學刊物上發錶中文論文、譯文及評論六十餘篇；曾獲第五屆中國高等學校科學研究優秀成果奬三等奬、中國國際私法首屆優秀學術成果奬一等奬、北京市第十屆、第十三屆哲學社會科學優秀成果奬二等奬、湖北省第六屆哲學社會科學優秀成果奬二等奬、中國政法大學優秀教師特彆奬、中國政法大學第三屆青年教師優秀科研成果奬一等奬、中國政法大學第四屆青年教師教學基本功大賽一等奬等奬項。

　　Given the lack of consensus on the subject's title, scope and nature, it is not surprising that there exists no universally accepted definition for private international law, and scholars of different countries formulate different definitions.This section introduces the definition of private international law from the perspective of Chinese law.
　　In Chinese textbooks, the classic definition is that "private international law is the branch of law that regulates international civil and commercial relations," or "the branch of law that deals with civil and commercial relations that involve foreign elements." In this context, it is vital to define the term "international" or "foreign."
　　As a matter of fact, Chinese private international law scholars have different opinions on the criterion for the classification between domestic and foreign (or international) cases.Some authors advocate that if a civil case involves the interests of more than one country, it should be qualified as a civil case involving foreign elements； otherwise, it should be as a purely domestic case.Nonetheless, others prefer a more objective approach which is called "three-element-test." Pursuant to this approach, if one of the following elements, i.e, the parties, the subject matter and the juristic fact, has contact with foreign jurisdiction, the case in question will be classified as the one involving foreign elements.
